iTrade - AI Trading Assistant Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the iTrade - AI Trading Assistant application ("App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Subscription Terms

2.1 Subscription Options

iTrade offers the following subscription options:

  • Free Version: Includes 1 chart analysis per day with advertisements
  • Monthly Premium Subscription: $9.99 per month
  • Annual Premium Subscription: $83.00 per year (approximately 31% discount compared to monthly subscription)

2.2 Subscription Features

Premium subscribers receive:

  • Unlimited chart analyses
  • No advertisements
  • Advanced trading insights
  • Market trend predictions
  • Personalized trading recommendations
  • Priority customer support

2.3 Subscription Management and Cancellation

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscription through your App Store or Google Play account settings. No refunds will be provided for partial subscription periods.

2.4 Payment Processing

All payments are processed securely through the Apple App Store or Google Play Store. We do not directly process or store any payment information.

2.5 Refund Policy

Refund requests must be made through the App Store/Play Store according to their respective refund policies. No refunds will be provided for:

  • Technical issues beyond our control
  • Changes in app features or functionality
  • User error or change of mind

Refund requests should be directed to the respective app store (Apple App Store or Google Play Store).

3. License to Use

Barnard Media grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal use on compatible devices.

4. App Features and Limitations

4.1 Financial Information Disclaimer

The App provides AI-powered trading insights and chart analysis. This information is provided for educational and informational purposes only and should not be construed as financial advice. Always consult with a qualified financial advisor before making investment decisions.

4.2 Accuracy of Information

While we strive to ensure accurate analysis, the App's predictions and recommendations are based on algorithmic interpretations of market data and historical patterns. Past performance is not indicative of future results, and no guarantee of trading success is provided or implied.

4.3 Data Storage

The App stores analysis history and preferences both locally on your device and in our secure cloud database. You can clear local data at any time through the app settings.

5. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose
  • Interfere with or disrupt the App's services
  • Attempt to gain unauthorized access to any part of the App
  • Use the App in a way that could damage or impair its functionality
  • Redistribute or sell the App or any part of it
  • Reverse engineer, decompile, or attempt to extract the source code
  • Use automated systems or software to extract data from the App

6. Technical Requirements

To use the App, you need:

  • A compatible mobile device with iOS 13.0+ or Android 8.0+
  • Sufficient storage space for local data (approximately 100MB)
  • An active internet connection for real-time data and analysis

7. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that:

  • The App will be error-free or uninterrupted
  • Analysis will be 100% accurate or profitable
  • The App will meet your specific requirements
  • Market data used for analysis will always be current or complete

8. Limitation of Liability

Barnard Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the App. This includes any financial losses resulting from investment decisions made based on the App's analysis or recommendations.

9. Changes to the App

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice. This includes changes to features, functionality, and subscription terms.

10. Changes to Terms

We may update these Terms of Use from time to time. Continued use of the App after any changes constitutes acceptance of the new terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of South Africa.
